The Indian Society of Artificial Intelligence and Law (ISAIL) is pleased to submit its feedback on the UK Civil Justice Council’s consultation regarding the use of AI for preparing court documents. Our submission focuses on understanding how artificial intelligence is currently being deployed in the drafting process and how its use can be seamlessly incorporated, supervised, and controlled within formal court filings. This becomes especially important in light of the rapid global rise of AI adoption by lawyers and legal professionals and the emerging risks that unregulated or unsupervised AI systems pose to the integrity of judicial processes. A key concern is the documented tendency of certain AI tools to hallucinate case law, misstate statutory provisions, fabricate citations, or generate legal reasoning that appears authoritative but is factually incorrect. These risks directly affect the reliability of court submissions and can undermine procedural fairness, professional accountability, and public trust in the justice system.

The Policy Innovation Committee of the Indian Society of Artificial Intelligence and Law has prepared a comprehensive set of responses for submission to the United Kingdom Civil Justice Council regarding the use of Artificial Intelligence in the preparation of court documents. This Outcome Document consolidates the feedback, proposals, and recommendations shared by legal representatives from diverse institutions, including law firms, government bodies, and independent practitioners, in relation to the questions raised in the Council’s Interim Report and Consultation Paper.

This document will also act like an anchor for the Indian stance on usage of AI in courts. Presently, states like Kerala and Gujarat have prepared their separate guidelines for the usage of AI in Courts. The Indian High Courts have come down hard on legal professionals using AI to draft petitions and highlighted the menace of hallucinations. Indian startups like Adalat AI are forthcoming with the ethical usage of AI in courts with translation, drafting and research capabilities. With these advancing discussions, India is leading the ethical deployment of AI in the Global South. 

Given the rapid and widespread adoption of AI tools by lawyers in day‑to‑day litigation workflows, the subject carries significant importance and urgency. The insights compiled in this document aim to support the Council in developing informed, balanced, and forward‑looking guidelines or safeguards governing the responsible use of AI in court‑related activities. By capturing perspectives from across the legal ecosystem, the document seeks to contribute meaningfully to the creation of a safe, transparent, and trustworthy environment for AI‑assisted legal drafting and procedural compliance.
